MEDIATION AND HOME STUDIES
Mediation involves bringing parties together who are not agreeing on an incapacitated individual’s circumstances. For example, if two sisters disagree on their mother’s care, a mediator will help the family negotiate what is in the best interest of the incapacitated person.
Home Studies are sometimes required when there is a disagreement over the guardianship or care of an individual. In this case, a Council On Aging employee will interview all parties and observe the individual’s home environment. He or she will then prepare a report and make a recommendation to the Court based on the best interests of the incapacitated person.
Both services are win-win options for resolving differences. They save the Court time and costs, save on attorney fees, and allow the family to utilize the money in other ways.
